Registration of Documents

Ensuring your legal documents are formally recognised in Jersey.

In Jersey, certain legal documents must be registered with the appropriate court or registry to ensure they are valid and enforceable. These documents can relate to various types of court order, wills or powers of attorney.

Our Expertise

At BCR, our team of experts assist individuals, families and professional advisors with the registration of legal documents in Jersey. Whether you are registering a Will of immovable estate, a Lasting Power of Attorney (LPA) or a foreign court order, we guide you through the requirements and liaise directly with the relevant authorities on your behalf.

Our Approach

We support the register of the following types of documents: -

Wills of Immovable Property

Under Jersey law, wills that deal with immovable property (i.e. land, buildings and property rights within Jersey) must be registered in the Jersey Public Registry before ownership of that property can be passed to the beneficiaries named.

We can assist with:

  • Reviewing the Will for correct formalities ensuring it complies with Jersey legal requirements.
  • Preparing the documents for submission to the Jersey Public Registry and coordinating registration.
  • Advising on property transfers and divisions following death.

This ensures that property rights pass properly to the intended beneficiaries and prevents later disputes.

Jersey Lasting Powers of Attorney (LPAs)

All LPAs in Jersey must be registered with the Judicial Greffe before they can be used. This applies to both Property and Affairs and Health and Welfare.

Registration ensures that attorneys have the legal authority to act, and it allows third parties (e.g. banks, care homes) to recognise an attorneys powers.

We can assist with:

  • Preparing LPA documents correctly.
  • Submitting them for registration.
  • Dealing with any queries raised by the Jersey Public Registry.
  • Advising attorneys on what their role involves once the LPA is registered.

Tutelle Orders and Matters Relating to Minors

Where someone is appointed as a Tuteur (legal financial guardian) for a minor or incapacitated adult under Jersey law, the court order must be registered for it to take effect. This applies to initial Tutelle appointments, variation orders and orders approving sales or financial decisions on behalf of the minor.

We help by:

  • Preparing the necessary affidavits and court documents.
  • Representing applicants before the Royal Court.
  • Ensuring proper registration of the final order.

Registered tutelle documents are often required by financial institutions, schools and government bodies when acting on behalf of a minor.

Foreign Court Orders and Powers

If you are relying on a power of attorney, guardianship or probate document made outside of Jersey, it will be necessary for that document to be registered with the Royal Court before it can be recognised and used as required in Jersey.

We advise on:

  • Whether the foreign document needs formal recognition.
  • Whether registration or resealing is required.
  • Translating and formatting the document for Jersey use.

This is common in cross-border estates or where an overseas family member is acting on behalf of a Jersey resident.
