Case: Thames Honda Ltd v Purkis
In this case, the claimant had been in a personal relationship with another employee, who was her senior. The relationship had broken down and a claim was brought for harassment.
The Tribunal concluded that an employer was vicariously liable for harassment that took place at work even though the claimant had previously been in a relationship with her colleague.
The Tribunal came to this decision on the basis that the harasser was calling the victim into his office and he was able to exercise this control over her as a more senior employee.
