Managing Partner, David Benest, has acted in many high profile and significant trust disputes and leads a team that has the experience to provide specialist and timely advice to settlors, trustees, corporate trustees, beneficiaries and protectors.
We are able to advise and assist across the whole range of trust disputes, including:
- applications to rectify a mistake
- applications in respect of momentous decisions
- the removal or retirement of trustees and protectors
- the transfer of trusteeships
- responding to requests for information
- prosecuting or defending breach of trust claims
- advising in respect of disputes between beneficiaries.
We are able to work closely with our expert lawyers in our Family Law and Private Client teams in order to provide advice and assistance to trustees and beneficiaries involved in matrimonial or other family proceedings, including advice to trustees as to the provision of information and on issues concerning submission to the jurisdiction of foreign family law proceedings. We often work with firms and counsels from other jurisdictions in complex, multi-jurisdictional proceedings.
We are able to guide parties to a dispute through the litigation process, including the investigation of complaints and claims, alternative dispute resolution, and, if necessary, trial.
