Alternative Dispute Resolution

Resolving disputes constructively, creatively, and fairly.

For many clients resolving a dispute outside of the court framework is the preferred strategic outcome.  Alternative Dispute Resolution (ADR) offers parties to a dispute flexibility, privacy, and efficiency, in resolving their differences.  ADR can allow for a more complete and creative resolution of issues than can be achieved by a Court decision.

The Jersey courts frequently encourage parties to engage in ADR and may penalise parties who unreasonably refuse to engage with it.

Our Expertise

At BCR, we have a long track record of successfully resolving cases through ADR. Our lawyers have successfully represented clients in all forms of ADR.  Our clients can rely on our legal expertise and commercial awareness to achieve the best outcomes for them outside of the court process.

Our experienced team has extensive specialism in:

  • Adjudication.
  • Arbitration.
  • Expert determination.
  • Mediation.
  • Negotiation.
  • Round table meetings.

Our Approach

We take the time to understand the core issues in the case as well as the broader context and what you really want to achieve by way of resolution.  We always advise on potential alternatives to the court process and give clients all the information they need to assess whether ADR is right for them and, if so, which process to pursue.

We prepare clients thoroughly so they know what to expect, help evaluate settlement options, and represent our clients’ interests at every stage to secure the best possible outcomes.  Our approach enables clients to navigate ADR with confidence and clarity.

ADR is not a sign of weakness. It is often a sign of strength, showcasing foresight, emotional intelligence, and a desire to control outcomes rather than surrendering them to the court.  If court is unavoidable, then our clients can rest assured of the support and representation of our team of expert courtroom advocates.
