For many clients resolving a dispute outside of the court framework is the preferred strategic outcome.  Alternative Dispute Resolution (ADR) offers parties to a dispute flexibility, privacy, and efficiency, in resolving their differences.  ADR can allow for a more complete and creative resolution of issues than can be achieved by a Court decision.

The Jersey courts frequently encourage parties to engage in ADR and may penalise parties who unreasonably refuse to engage with it.
